  2. By exercising the Licensed Rights (defined below), You accept and agree to be
  3. bound by the terms and conditions of this Creative Commons
  4. Attribution-ShareAlike 4.0 International Public License ("Public License"). To
  5. the extent this Public License may be interpreted as a contract, You are granted
  6. the Licensed Rights in consideration of Your acceptance of these terms and
  7. conditions, and the Licensor grants You such rights in consideration of benefits
  8. the Licensor receives from making the Licensed Material available under these
  9. terms and conditions.
  10. Section 1 – Definitions.
  11. a. Adapted Material means material subject to Copyright and Similar
  12. Rights that is derived from or based upon the Licensed Material and
  13. in which the Licensed Material is translated, altered, arranged,
  14. transformed, or otherwise modified in a manner requiring permission
  15. under the Copyright and Similar Rights held by the Licensor. For
  16. purposes of this Public License, where the Licensed Material is a
  17. musical work, performance, or sound recording, Adapted Material is
  18. always produced where the Licensed Material is synched in timed
  19. relation with a moving image.
  20. b. Adapter's License means the license You apply to Your Copyright and
  21. Similar Rights in Your contributions to Adapted Material in
  22. accordance with the terms and conditions of this Public License.
  23. c. BY-SA Compatible License means a license listed at
  24. creativecommons.org/compatiblelicenses, approved by Creative Commons
  25. as essentially the equivalent of this Public License.
  26. d. Copyright and Similar Rights means copyright and/or similar rights
  27. closely related to copyright including, without limitation,
  28. performance, broadcast, sound recording, and Sui Generis Database
  29. Rights, without regard to how the rights are labeled or categorized.
  30. For purposes of this Public License, the rights specified in Section
  31. 2(b)(1)-(2) are not Copyright and Similar Rights.
  32. e. Effective Technological Measures means those measures that, in the
  33. absence of proper authority, may not be circumvented under laws
  34. fulfilling obligations under Article 11 of the WIPO Copyright Treaty
  35. adopted on December 20, 1996, and/or similar
  36. international agreements.
  37. f. Exceptions and Limitations means fair use, fair dealing, and/or any
  38. other exception or limitation to Copyright and Similar Rights that
  39. applies to Your use of the Licensed Material.
  40. g. License Elements means the license attributes listed in the name of a
  41. Creative Commons Public License. The License Elements of this Public
  42. License are Attribution and ShareAlike.
  43. h. Licensed Material means the artistic or literary work, database, or
  44. other material to which the Licensor applied this Public License.
  45. i. Licensed Rights means the rights granted to You subject to the terms
  46. and conditions of this Public License, which are limited to all
  47. Copyright and Similar Rights that apply to Your use of the Licensed
  48. Material and that the Licensor has authority to license.
  49. j. Licensor means the individual(s) or entity(ies) granting rights under
  50. this Public License.
  51. k. Share means to provide material to the public by any means or process
  52. that requires permission under the Licensed Rights, such as
  53. reproduction, public display, public performance, distribution,
  54. dissemination, communication, or importation, and to make material
  55. available to the public including in ways that members of the public
  56. may access the material from a place and at a time individually
  57. chosen by them.
  58. l. Sui Generis Database Rights means rights other than copyright
  59. resulting from Directive 96/9/EC of the European Parliament and of
  60. the Council of 11 March 1996 on the legal protection of databases, as
  61. amended and/or succeeded, as well as other essentially equivalent
  62. rights anywhere in the world.
  63. m. You means the individual or entity exercising the Licensed Rights
  64. under this Public License. Your has a corresponding meaning.
  65. Section 2 – Scope.
  66. a. License grant.
  67. 1. Subject to the terms and conditions of this Public License,
  68. the Licensor hereby grants You a worldwide, royalty-free,
  69. non-sublicensable, non-exclusive, irrevocable license to
  70. exercise the Licensed Rights in the Licensed Material to:
  71. A. reproduce and Share the Licensed Material, in whole
  72. or in part; and produce, reproduce, and Share
  73. Adapted Material.
  74. 2. Exceptions and Limitations. For the avoidance of doubt,
  75. where Exceptions and Limitations apply to Your use, this
  76. Public License does not apply, and You do not need to comply
  77. with its terms and conditions.
  78. 3. Term. The term of this Public License is specified in
  79. Section 6(a).
  80. 4. Media and formats; technical modifications allowed. The
  81. Licensor authorizes You to exercise the Licensed Rights in
  82. all media and formats whether now known or hereafter created,
  83. and to make technical modifications necessary to do so. The
  84. Licensor waives and/or agrees not to assert any right or
  85. authority to forbid You from making technical modifications
  86. necessary to exercise the Licensed Rights, including
  87. technical modifications necessary to circumvent Effective
  88. Technological Measures. For purposes of this Public License,
  89. simply making modifications authorized by this Section
  90. 2(a)(4) never produces Adapted Material.
  91. 5. Downstream recipients.
  92. A. Offer from the Licensor – Licensed Material. Every
  93. recipient of the Licensed Material automatically
  94. receives an offer from the Licensor to exercise the
  95. Licensed Rights under the terms and conditions of
  96. this Public License.
  97. B. Additional offer from the Licensor – Adapted
  98. Material. Every recipient of Adapted Material from
  99. You automatically receives an offer from the Licensor
  100. to exercise the Licensed Rights in the Adapted
  101. Material under the conditions of the Adapter's
  102. License You apply.
  103. C. No downstream restrictions. You may not offer or
  104. impose any additional or different terms or
  105. conditions on, or apply any Effective Technological
  106. Measures to, the Licensed Material if doing so
  107. restricts exercise of the Licensed Rights by any
  108. recipient of the Licensed Material.
  109. 6. No endorsement. Nothing in this Public License constitutes or
  110. may be construed as permission to assert or imply that You
  111. are, or that Your use of the Licensed Material is, connected
  112. with, or sponsored, endorsed, or granted official status by,
  113. the Licensor or others designated to receive attribution as
  114. provided in Section 3(a)(1)(A)(i).
  115. b. Other rights.
  116. 1. Moral rights, such as the right of integrity, are not
  117. licensed under this Public License, nor are publicity,
  118. privacy, and/or other similar personality rights; however, to
  119. the extent possible, the Licensor waives and/or agrees not to
  120. assert any such rights held by the Licensor to the limited
  121. extent necessary to allow You to exercise the Licensed
  122. Rights, but not otherwise.
  123. 2. Patent and trademark rights are not licensed under this
  124. Public License.
  125. 3. To the extent possible, the Licensor waives any right to
  126. collect royalties from You for the exercise of the Licensed
  127. Rights, whether directly or through a collecting society under
  128. any voluntary or waivable statutory or compulsory licensing
  129. scheme. In all other cases the Licensor expressly reserves any
  130. right to collect such royalties.
  131. Section 3 – License Conditions.
  132. Your exercise of the Licensed Rights is expressly made subject to the following
  133. conditions.
  134. a. Attribution.
  135. 1. If You Share the Licensed Material (including in modified
  136. form), You must:
  137. A. retain the following if it is supplied by the
  138. Licensor with the Licensed Material:
  139. i. identification of the creator(s) of the
  140. Licensed Material and any others designated
  141. to receive attribution, in any reasonable
  142. manner requested by the Licensor (including
  143. by pseudonym if designated);
  144. ii. a copyright notice;
  145. iii. a notice that refers to this Public License;
  146. iv. a notice that refers to the disclaimer of
  147. warranties;
  148. v. a URI or hyperlink to the Licensed Material
  149. to the extent reasonably practicable;
  150. B. indicate if You modified the Licensed Material and
  151. retain an indication of any previous
  152. modifications; and
  153. C. indicate the Licensed Material is licensed under this
  154. Public License, and include the text of, or the URI
  155. or hyperlink to, this Public License.
  156. 2. You may satisfy the conditions in Section 3(a)(1) in any
  157. reasonable manner based on the medium, means, and context in
  158. which You Share the Licensed Material. For example, it may be
  159. reasonable to satisfy the conditions by providing a URI or
  160. hyperlink to a resource that includes the
  161. required information.
  162. 3. If requested by the Licensor, You must remove any of the
  163. information required by Section 3(a)(1)(A) to the extent

  165. b. ShareAlike.
  166. In addition to the conditions in Section 3(a), if You Share Adapted
  167. Material You produce, the following conditions also apply.
  168. 1. The Adapter's License You apply must be a Creative Commons
  169. license with the same License Elements, this version or
  170. later, or a BY-SA Compatible License.
  171. 2. You must include the text of, or the URI or hyperlink to, the
  172. Adapter's License You apply. You may satisfy this condition
  173. in any reasonable manner based on the medium, means, and
  174. context in which You Share Adapted Material.
  175. 3. You may not offer or impose any additional or different terms
  176. or conditions on, or apply any Effective Technological
  177. Measures to, Adapted Material that restrict exercise of the
  178. rights granted under the Adapter's License You apply.
  179. Section 4 – Sui Generis Database Rights.
  180. Where the Licensed Rights include Sui Generis Database Rights that apply to Your
  181. use of the Licensed Material:
  182. a. for the avoidance of doubt, Section 2(a)(1) grants You the right to
  183. extract, reuse, reproduce, and Share all or a substantial portion of
  184. the contents of the database;
  185. b. if You include all or a substantial portion of the database contents
  186. in a database in which You have Sui Generis Database Rights, then the
  187. database in which You have Sui Generis Database Rights (but not its
  188. individual contents) is Adapted Material, including for purposes of
  189. Section 3(b); and
  190. c. You must comply with the conditions in Section 3(a) if You Share all
  191. or a substantial portion of the contents of the database.
  192. For the avoidance of doubt, this Section 4 supplements and does not replace Your
  193. obligations under this Public License where the Licensed Rights include other
  194. Copyright and Similar Rights.
  195. Section 5 – Disclaimer of Warranties and Limitation of Liability.
  196. a. Unless otherwise separately undertaken by the Licensor, to the extent
  197. possible, the Licensor offers the Licensed Material as-is and as-
  198. available, and makes no representations or warranties of any kind
  199. concerning the Licensed Material, whether express, implied,
  200. statutory, or other. This includes, without limitation, warranties of
  201. title, merchantability, fitness for a particular purpose, non-
  202. infringement, absence of latent or other defects, accuracy, or the
  203. presence or absence of errors, whether or not known or discoverable.
  204. Where disclaimers of warranties are not allowed in full or in part,
  205. this disclaimer may not apply to You.
  206. b. To the extent possible, in no event will the Licensor be liable to
  207. You on any legal theory (including, without limitation, negligence)
  208. or otherwise for any direct, special, indirect, incidental,
  209. consequential, punitive, exemplary, or other losses, costs, expenses,
  210. or damages arising out of this Public License or use of the Licensed
  211. Material, even if the Licensor has been advised of the possibility of
  212. such losses, costs, expenses, or damages. Where a limitation of
  213. liability is not allowed in full or in part, this limitation may not
  214. apply to You.
  215. c. The disclaimer of warranties and limitation of liability provided
  216. above shall be interpreted in a manner that, to the extent possible,
  217. most closely approximates an absolute disclaimer and waiver of
  218. all liability.
  219. Section 6 – Term and Termination.
  220. a. This Public License applies for the term of the Copyright and Similar
  221. Rights licensed here. However, if You fail to comply with this Public
  222. License, then Your rights under this Public License
  223. terminate automatically.
  224. b. Where Your right to use the Licensed Material has terminated under
  225. Section 6(a), it reinstates:
  226. 1. automatically as of the date the violation is cured, provided
  227. it is cured within 30 days of Your discovery of the violation;
  228. or upon express reinstatement by the Licensor.
  229. For the avoidance of doubt, this Section 6(b) does not affect any
  230. right the Licensor may have to seek remedies for Your violations of
  231. this Public License.
  232. c. For the avoidance of doubt, the Licensor may also offer the Licensed
  233. Material under separate terms or conditions or stop distributing the
  234. Licensed Material at any time; however, doing so will not terminate
  235. this Public License.
  236. d. Sections 1, 5, 6, 7, and 8 survive termination of this
  237. Public License.
  238. Section 7 – Other Terms and Conditions.
  239. a. The Licensor shall not be bound by any additional or different terms
  240. or conditions communicated by You unless expressly agreed.
  241. b. Any arrangements, understandings, or agreements regarding the
  242. Licensed Material not stated herein are separate from and independent
  243. of the terms and conditions of this Public License.
  244. Section 8 – Interpretation.
  245. a. For the avoidance of doubt, this Public License does not, and shall
  246. not be interpreted to, reduce, limit, restrict, or impose conditions
  247. on any use of the Licensed Material that could lawfully be made
  248. without permission under this Public License.
  249. b. To the extent possible, if any provision of this Public License is
  250. deemed unenforceable, it shall be automatically reformed to the
  251. minimum extent necessary to make it enforceable. If the provision
  252. cannot be reformed, it shall be severed from this Public License
  253. without affecting the enforceability of the remaining terms
  254. and conditions.
  255. c. No term or condition of this Public License will be waived and no
  256. failure to comply consented to unless expressly agreed to by
  257. the Licensor.
  258. d. Nothing in this Public License constitutes or may be interpreted as a
  259. limitation upon, or waiver of, any privileges and immunities that
  260. apply to the Licensor or You, including from the legal processes of
  261. any jurisdiction or authority.
