  26. Considerations for the public: By using one of our public licenses, a licensor

  28. and conditions. If the licensor’s permission is not necessary for any

  38. Creative Commons Attribution-ShareAlike 4.0 International Public License
  39. By exercising the Licensed Rights (defined below), You accept and agree to be
  40. bound by the terms and conditions of this Creative Commons
  41. Attribution-ShareAlike 4.0 International Public License ("Public License"). To
  42. the extent this Public License may be interpreted as a contract, You are
  43. granted the Licensed Rights in consideration of Your acceptance of these terms
  44. and conditions, and the Licensor grants You such rights in consideration of
  45. benefits the Licensor receives from making the Licensed Material available
  46. under these terms and conditions.
  47. Section 1 – Definitions.
  48. a. Adapted Material means material subject to Copyright and Similar Rights
  49. that is derived from or based upon the Licensed Material and in which the
  50. Licensed Material is translated, altered, arranged, transformed, or otherwise
  51. modified in a manner requiring permission under the Copyright and Similar
  52. Rights held by the Licensor. For purposes of this Public License, where the
  53. Licensed Material is a musical work, performance, or sound recording, Adapted
  54. Material is always produced where the Licensed Material is synched in timed
  55. relation with a moving image.
  56. b. Adapter's License means the license You apply to Your Copyright and
  57. Similar Rights in Your contributions to Adapted Material in accordance with the
  58. terms and conditions of this Public License.
  59. c. BY-SA Compatible License means a license listed at
  60. creativecommons.org/compatiblelicenses, approved by Creative Commons as
  61. essentially the equivalent of this Public License.
  62. d. Copyright and Similar Rights means copyright and/or similar rights
  63. closely related to copyright including, without limitation, performance,
  64. broadcast, sound recording, and Sui Generis Database Rights, without regard to
  65. how the rights are labeled or categorized. For purposes of this Public License,
  66. the rights specified in Section 2(b)(1)-(2) are not Copyright and Similar
  67. Rights.
  68. e. Effective Technological Measures means those measures that, in the
  69. absence of proper authority, may not be circumvented under laws fulfilling
  70. obligations under Article 11 of the WIPO Copyright Treaty adopted on December
  71. 20, 1996, and/or similar international agreements.
  72. f. Exceptions and Limitations means fair use, fair dealing, and/or any
  73. other exception or limitation to Copyright and Similar Rights that applies to
  74. Your use of the Licensed Material.
  75. g. License Elements means the license attributes listed in the name of a
  76. Creative Commons Public License. The License Elements of this Public License
  77. are Attribution and ShareAlike.
  78. h. Licensed Material means the artistic or literary work, database, or
  79. other material to which the Licensor applied this Public License.
  80. i. Licensed Rights means the rights granted to You subject to the terms
  81. and conditions of this Public License, which are limited to all Copyright and
  82. Similar Rights that apply to Your use of the Licensed Material and that the
  83. Licensor has authority to license.
  84. j. Licensor means the individual(s) or entity(ies) granting rights under
  85. this Public License.
  86. k. Share means to provide material to the public by any means or process
  87. that requires permission under the Licensed Rights, such as reproduction,
  88. public display, public performance, distribution, dissemination, communication,
  89. or importation, and to make material available to the public including in ways
  90. that members of the public may access the material from a place and at a time
  91. individually chosen by them.
  92. l. Sui Generis Database Rights means rights other than copyright resulting
  93. from Directive 96/9/EC of the European Parliament and of the Council of 11
  94. March 1996 on the legal protection of databases, as amended and/or succeeded,
  95. as well as other essentially equivalent rights anywhere in the world.
  96. m. You means the individual or entity exercising the Licensed Rights under
  97. this Public License. Your has a corresponding meaning.
  98. Section 2 – Scope.
  99. a. License grant.
  100. 1. Subject to the terms and conditions of this Public License, the
  101. Licensor hereby grants You a worldwide, royalty-free, non-sublicensable,
  102. non-exclusive, irrevocable license to exercise the Licensed Rights in the
  103. Licensed Material to:
  104. A. reproduce and Share the Licensed Material, in whole or in
  105. part; and
  106. B. produce, reproduce, and Share Adapted Material.
  107. 2. Exceptions and Limitations. For the avoidance of doubt, where
  108. Exceptions and Limitations apply to Your use, this Public License does not
  109. apply, and You do not need to comply with its terms and conditions.
  110. 3. Term. The term of this Public License is specified in Section 6(a).
  111. 4. Media and formats; technical modifications allowed. The Licensor
  112. authorizes You to exercise the Licensed Rights in all media and formats whether
  113. now known or hereafter created, and to make technical modifications necessary
  114. to do so. The Licensor waives and/or agrees not to assert any right or
  115. authority to forbid You from making technical modifications necessary to
  116. exercise the Licensed Rights, including technical modifications necessary to
  117. circumvent Effective Technological Measures. For purposes of this Public
  118. License, simply making modifications authorized by this Section 2(a)(4) never
  119. produces Adapted Material.
  120. 5. Downstream recipients.
  121. A. Offer from the Licensor – Licensed Material. Every
  122. recipient of the Licensed Material automatically receives an offer from the
  123. Licensor to exercise the Licensed Rights under the terms and conditions of this
  124. Public License.
  125. B. Additional offer from the Licensor – Adapted Material.
  126. Every recipient of Adapted Material from You automatically receives an offer
  127. from the Licensor to exercise the Licensed Rights in the Adapted Material under
  128. the conditions of the Adapter’s License You apply.
  129. C. No downstream restrictions. You may not offer or impose any
  130. additional or different terms or conditions on, or apply any Effective
  131. Technological Measures to, the Licensed Material if doing so restricts exercise
  132. of the Licensed Rights by any recipient of the Licensed Material.
  133. 6. No endorsement. Nothing in this Public License constitutes or may
  134. be construed as permission to assert or imply that You are, or that Your use of
  135. the Licensed Material is, connected with, or sponsored, endorsed, or granted
  136. official status by, the Licensor or others designated to receive attribution as
  137. provided in Section 3(a)(1)(A)(i).
  138. b. Other rights.
  139. 1. Moral rights, such as the right of integrity, are not licensed
  140. under this Public License, nor are publicity, privacy, and/or other similar
  141. personality rights; however, to the extent possible, the Licensor waives and/or
  142. agrees not to assert any such rights held by the Licensor to the limited extent
  143. necessary to allow You to exercise the Licensed Rights, but not otherwise.
  144. 2. Patent and trademark rights are not licensed under this Public
  145. License.
  146. 3. To the extent possible, the Licensor waives any right to collect
  147. royalties from You for the exercise of the Licensed Rights, whether directly or
  148. through a collecting society under any voluntary or waivable statutory or
  149. compulsory licensing scheme. In all other cases the Licensor expressly reserves
  150. any right to collect such royalties.
  151. Section 3 – License Conditions.
  152. Your exercise of the Licensed Rights is expressly made subject to the following
  153. conditions.
  154. a. Attribution.
  155. 1. If You Share the Licensed Material (including in modified form),
  156. You must:
  157. A. retain the following if it is supplied by the Licensor with
  158. the Licensed Material:
  159. i. identification of the creator(s) of the Licensed
  160. Material and any others designated to receive attribution, in any reasonable
  161. manner requested by the Licensor (including by pseudonym if designated);
  162. ii. a copyright notice;
  163. iii. a notice that refers to this Public License;
  164. iv. a notice that refers to the disclaimer of warranties;
  165. v. a URI or hyperlink to the Licensed Material to the
  166. extent reasonably practicable;
  167. B. indicate if You modified the Licensed Material and retain an
  168. indication of any previous modifications; and
  169. C. indicate the Licensed Material is licensed under this Public
  170. License, and include the text of, or the URI or hyperlink to, this Public
  171. License.
  172. 2. You may satisfy the conditions in Section 3(a)(1) in any
  173. reasonable manner based on the medium, means, and context in which You Share
  174. the Licensed Material. For example, it may be reasonable to satisfy the
  175. conditions by providing a URI or hyperlink to a resource that includes the
  176. required information.
  177. 3. If requested by the Licensor, You must remove any of the
  178. information required by Section 3(a)(1)(A) to the extent reasonably practicable.
  179. b. ShareAlike.In addition to the conditions in Section 3(a), if You Share
  180. Adapted Material You produce, the following conditions also apply.
  181. 1. The Adapter’s License You apply must be a Creative Commons
  182. license with the same License Elements, this version or later, or a BY-SA
  183. Compatible License.
  184. 2. You must include the text of, or the URI or hyperlink to, the
  185. Adapter's License You apply. You may satisfy this condition in any reasonable
  186. manner based on the medium, means, and context in which You Share Adapted
  187. Material.
  188. 3. You may not offer or impose any additional or different terms or
  189. conditions on, or apply any Effective Technological Measures to, Adapted
  190. Material that restrict exercise of the rights granted under the Adapter's
  191. License You apply.
  192. Section 4 – Sui Generis Database Rights.
  193. Where the Licensed Rights include Sui Generis Database Rights that apply to
  194. Your use of the Licensed Material:
  195. a. for the avoidance of doubt, Section 2(a)(1) grants You the right to
  196. extract, reuse, reproduce, and Share all or a substantial portion of the
  197. contents of the database;
  198. b. if You include all or a substantial portion of the database contents in
  199. a database in which You have Sui Generis Database Rights, then the database in
  200. which You have Sui Generis Database Rights (but not its individual contents) is
  201. Adapted Material, including for purposes of Section 3(b); and
  202. c. You must comply with the conditions in Section 3(a) if You Share all or
  203. a substantial portion of the contents of the database.
  204. For the avoidance of doubt, this Section 4 supplements and does not replace
  205. Your obligations under this Public License where the Licensed Rights include
  206. other Copyright and Similar Rights.
  207. Section 5 – Disclaimer of Warranties and Limitation of Liability.
  208. a. Unless otherwise separately undertaken by the Licensor, to the extent
  209. possible, the Licensor offers the Licensed Material as-is and as-available, and
  210. makes no representations or warranties of any kind concerning the Licensed
  211. Material, whether express, implied, statutory, or other. This includes, without
  212. limitation, warranties of title, merchantability, fitness for a particular
  213. purpose, non-infringement, absence of latent or other defects, accuracy, or the
  214. presence or absence of errors, whether or not known or discoverable. Where
  215. disclaimers of warranties are not allowed in full or in part, this disclaimer
  216. may not apply to You.
  217. b. To the extent possible, in no event will the Licensor be liable to You
  218. on any legal theory (including, without limitation, negligence) or otherwise
  219. for any direct, special, indirect, incidental, consequential, punitive,
  220. exemplary, or other losses, costs, expenses, or damages arising out of this
  221. Public License or use of the Licensed Material, even if the Licensor has been
  222. advised of the possibility of such losses, costs, expenses, or damages. Where a
  223. limitation of liability is not allowed in full or in part, this limitation may
  224. not apply to You.
  225. c. The disclaimer of warranties and limitation of liability provided above
  226. shall be interpreted in a manner that, to the extent possible, most closely
  227. approximates an absolute disclaimer and waiver of all liability.
  228. Section 6 – Term and Termination.
  229. a. This Public License applies for the term of the Copyright and Similar
  230. Rights licensed here. However, if You fail to comply with this Public License,
  231. then Your rights under this Public License terminate automatically.
  232. b. Where Your right to use the Licensed Material has terminated under
  233. Section 6(a), it reinstates:
  234. 1. automatically as of the date the violation is cured, provided it
  235. is cured within 30 days of Your discovery of the violation; or
  236. 2. upon express reinstatement by the Licensor.
  237. c. For the avoidance of doubt, this Section 6(b) does not affect any right
  238. the Licensor may have to seek remedies for Your violations of this Public
  239. License.
  240. d. For the avoidance of doubt, the Licensor may also offer the Licensed
  241. Material under separate terms or conditions or stop distributing the Licensed
  242. Material at any time; however, doing so will not terminate this Public License.
  243. e. Sections 1, 5, 6, 7, and 8 survive termination of this Public License.
  244. Section 7 – Other Terms and Conditions.
  245. a. The Licensor shall not be bound by any additional or different terms or
  246. conditions communicated by You unless expressly agreed.
  247. b. Any arrangements, understandings, or agreements regarding the Licensed
  248. Material not stated herein are separate from and independent of the terms and
  249. conditions of this Public License.
  250. Section 8 – Interpretation.
  251. a. For the avoidance of doubt, this Public License does not, and shall not
  252. be interpreted to, reduce, limit, restrict, or impose conditions on any use of
  253. the Licensed Material that could lawfully be made without permission under this
  254. Public License.
  255. b. To the extent possible, if any provision of this Public License is
  256. deemed unenforceable, it shall be automatically reformed to the minimum extent
  257. necessary to make it enforceable. If the provision cannot be reformed, it shall
  258. be severed from this Public License without affecting the enforceability of the
  259. remaining terms and conditions.
  260. c. No term or condition of this Public License will be waived and no
  261. failure to comply consented to unless expressly agreed to by the Licensor.
  262. d. Nothing in this Public License constitutes or may be interpreted as a
  263. limitation upon, or waiver of, any privileges and immunities that apply to the
  264. Licensor or You, including from the legal processes of any jurisdiction or
  265. authority.
  266. Creative Commons is not a party to its public licenses. Notwithstanding,
  267. Creative Commons may elect to apply one of its public licenses to material it
  268. publishes and in those instances will be considered the “Licensor.” Except
  269. for the limited purpose of indicating that material is shared under a Creative
  270. Commons public license or as otherwise permitted by the Creative Commons
  271. policies published at creativecommons.org/policies, Creative Commons does not
  272. authorize the use of the trademark “Creative Commons” or any other
  273. trademark or logo of Creative Commons without its prior written consent
  274. including, without limitation, in connection with any unauthorized
  275. modifications to any of its public licenses or any other arrangements,
  276. understandings, or agreements concerning use of licensed material. For the
  277. avoidance of doubt, this paragraph does not form part of the public
  278. licenses.
