  9. Statement of Purpose
  10. The laws of most jurisdictions throughout the world automatically
  11. confer exclusive Copyright and Related Rights (defined below) upon the
  12. creator and subsequent owner(s) (each and all, an "owner") of an
  13. original work of authorship and/or a database (each, a "Work").
  14. Certain owners wish to permanently relinquish those rights to a Work
  15. for the purpose of contributing to a commons of creative, cultural and
  16. scientific works ("Commons") that the public can reliably and without
  17. fear of later claims of infringement build upon, modify, incorporate
  18. in other works, reuse and redistribute as freely as possible in any
  19. form whatsoever and for any purposes, including without limitation
  20. commercial purposes. These owners may contribute to the Commons to
  21. promote the ideal of a free culture and the further production of
  22. creative, cultural and scientific works, or to gain reputation or
  23. greater distribution for their Work in part through the use and
  24. efforts of others.
  25. For these and/or other purposes and motivations, and without any
  26. expectation of additional consideration or compensation, the person
  27. associating CC0 with a Work (the "Affirmer"), to the extent that he or
  28. she is an owner of Copyright and Related Rights in the Work,
  29. voluntarily elects to apply CC0 to the Work and publicly distribute
  30. the Work under its terms, with knowledge of his or her Copyright and
  31. Related Rights in the Work and the meaning and intended legal effect
  32. of CC0 on those rights.
  33. 1. Copyright and Related Rights. A Work made available under CC0 may
  34. be protected by copyright and related or neighboring rights
  35. ("Copyright and Related Rights"). Copyright and Related Rights
  36. include, but are not limited to, the following:
  37. the right to reproduce, adapt, distribute, perform, display,
  38. communicate, and translate a Work; moral rights retained by the
  39. original author(s) and/or performer(s); publicity and privacy
  40. rights pertaining to a person's image or likeness depicted in a
  41. Work; rights protecting against unfair competition in regards to a
  42. Work, subject to the limitations in paragraph 4(a), below; rights
  43. protecting the extraction, dissemination, use and reuse of data in
  44. a Work; database rights (such as those arising under Directive
  45. 96/9/EC of the European Parliament and of the Council of 11 March
  46. 1996 on the legal protection of databases, and under any national
  47. implementation thereof, including any amended or successor version
  48. of such directive); and other similar, equivalent or corresponding
  49. rights throughout the world based on applicable law or treaty, and
  50. any national implementations thereof.
  51. 2. Waiver. To the greatest extent permitted by, but not in
  52. contravention of, applicable law, Affirmer hereby overtly, fully,
  53. permanently, irrevocably and unconditionally waives, abandons, and
  54. surrenders all of Affirmer's Copyright and Related Rights and
  55. associated claims and causes of action, whether now known or unknown
  56. (including existing as well as future claims and causes of action), in
  57. the Work (i) in all territories worldwide, (ii) for the maximum
  58. duration provided by applicable law or treaty (including future time
  59. extensions), (iii) in any current or future medium and for any number
  60. of copies, and (iv) for any purpose whatsoever, including without
  61. limitation commercial, advertising or promotional purposes (the
  62. "Waiver"). Affirmer makes the Waiver for the benefit of each member of
  63. the public at large and to the detriment of Affirmer's heirs and
  64. successors, fully intending that such Waiver shall not be subject to
  65. revocation, rescission, cancellation, termination, or any other legal
  66. or equitable action to disrupt the quiet enjoyment of the Work by the
  67. public as contemplated by Affirmer's express Statement of Purpose.
  68. 3. Public License Fallback. Should any part of the Waiver for any
  69. reason be judged legally invalid or ineffective under applicable law,
  70. then the Waiver shall be preserved to the maximum extent permitted
  71. taking into account Affirmer's express Statement of Purpose. In
  72. addition, to the extent the Waiver is so judged Affirmer hereby grants
  73. to each affected person a royalty-free, non transferable, non
  74. sublicensable, non exclusive, irrevocable and unconditional license to
  75. exercise Affirmer's Copyright and Related Rights in the Work (i) in
  76. all territories worldwide, (ii) for the maximum duration provided by
  77. applicable law or treaty (including future time extensions), (iii) in
  78. any current or future medium and for any number of copies, and (iv)
  79. for any purpose whatsoever, including without limitation commercial,
  80. advertising or promotional purposes (the "License"). The License shall
  81. be deemed effective as of the date CC0 was applied by Affirmer to the
  82. Work. Should any part of the License for any reason be judged legally
  83. invalid or ineffective under applicable law, such partial invalidity
  84. or ineffectiveness shall not invalidate the remainder of the License,
  85. and in such case Affirmer hereby affirms that he or she will not (i)
  86. exercise any of his or her remaining Copyright and Related Rights in
  87. the Work or (ii) assert any associated claims and causes of action
  88. with respect to the Work, in either case contrary to Affirmer's
  89. express Statement of Purpose.
  90. 4. Limitations and Disclaimers.
  91. No trademark or patent rights held by Affirmer are waived,
  92. abandoned, surrendered, licensed or otherwise affected by this
  93. document. Affirmer offers the Work as-is and makes no
  94. representations or warranties of any kind concerning the Work,
  95. express, implied, statutory or otherwise, including without
  96. limitation warranties of title, merchantability, fitness for a
  97. particular purpose, non infringement, or the absence of latent or
  98. other defects, accuracy, or the present or absence of errors,
  99. whether or not discoverable, all to the greatest extent
  100. permissible under applicable law. Affirmer disclaims
  101. responsibility for clearing rights of other persons that may apply
  102. to the Work or any use thereof, including without limitation any
  103. person's Copyright and Related Rights in the Work. Further,
  104. Affirmer disclaims responsibility for obtaining any necessary
  105. consents, permissions or other rights required for any use of the
  106. Work. Affirmer understands and acknowledges that Creative Commons
  107. is not a party to this document and has no duty or obligation with
  108. respect to this CC0 or use of the Work.
